Welcome to Neuron Connect. These Terms of Service ("Terms") govern your access to and use of the Neuron Connect website at neuron-connect.com, our clinical services, and any related applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing or using the Neuron Connect website or Services, you affirm that you are at least 18 years of age, or that you are a parent or legal guardian who has provided consent for a minor in your care to use our Services. If you are accessing the Services on behalf of a minor, you accept these Terms on that minor's behalf and are responsible for their use of the Services. By continuing to use the website after any updates to these Terms, you accept the revised Terms in full.

2. Medical Disclaimer

Not Medical Advice: The content provided on the Neuron Connect website, including text, graphics, images, blog articles, and other material, is for informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

No Doctor-Patient Relationship: Use of this website or communication with Neuron Connect via this website does not establish a doctor-patient or therapist-client relationship. Such a relationship is only established after a formal in-person or telehealth consultation and the completion of all necessary intake and consent forms.

3. Description of Services

Neuron Connect provides the following clinical services at our Arizona locations:

• qEEG Brain Mapping: Quantitative electroencephalography assessments to map brainwave activity, identify dysregulation patterns, and guide neurofeedback protocols.
• Neurofeedback Therapy: Real-time brainwave training sessions designed to support neurological regulation, focus, emotional stability, and recovery.
• Trauma Counseling and EMDR: Trauma-focused therapy including Eye Movement Desensitization and Reprocessing (EMDR) for PTSD, anxiety, depression, and traumatic stress.
• Personal Injury Neurological Care: Specialized evaluation and treatment for individuals who have sustained neurological injuries as a result of accidents, coordinated with legal representation under attorney-lien agreements.

4. Services and Outcomes

Our treatments are evidence-based and designed to support neurological regulation, recovery, and optimal brain function. However, we do not guarantee specific outcomes or results. Individual responses to therapy vary based on numerous factors including medical history, severity of symptoms, adherence to treatment protocols, concurrent medications, lifestyle factors, and individual physiology.

Neuron Connect's services are not a replacement for emergency medical care. If you are experiencing a medical emergency, please call 911 or go to your nearest emergency room immediately.

5. Patient Responsibilities

When using our Services or receiving care at Neuron Connect, you agree to:

• Provide accurate, current, and complete information on all intake forms and during consultations, including a full and honest medical history.
• Maintain the security and confidentiality of any patient portal credentials provided to you and promptly notify us of any unauthorized access.
• Promptly update your contact information and medical history whenever changes occur.
• Follow your prescribed treatment protocol as directed by your clinician, including completing recommended session frequencies.
• Arrive on time for scheduled appointments. Late arrivals may result in a shortened session at the full session rate.
• Use our website and Services only for lawful purposes and in accordance with these Terms.

6. Appointment and Cancellation Policy

We require a minimum of 24 hours advance notice to cancel or reschedule an appointment without penalty. Late cancellations made with less than 24 hours notice, and appointments missed without any notice (no-shows), may be subject to a cancellation fee as outlined in your patient intake agreement.

Repeated late cancellations or no-shows may result in discharge from care at the discretion of your treating clinician. We understand that emergencies occur and will consider extenuating circumstances on a case-by-case basis. Please contact our office as early as possible if you are unable to attend a scheduled appointment.

7. Attorney-Lien and Payment Terms

For patients receiving care under a personal injury attorney lien, a formal lien agreement must be signed by both the patient and their attorney of record prior to the commencement of treatment. By submitting a request for personal injury care, you acknowledge that coordination with your legal representation will be required, and that payment for services rendered under lien is due at the time of final legal settlement of your case.

For standard (non-lien) patients, payment is due at the time of service unless alternative arrangements have been made in advance. Neuron Connect accepts:

• Major insurance plans (verify coverage prior to your first appointment)
• Employee Sponsored Accounts (ESA)
• Health Savings Accounts (HSA) and Flexible Spending Accounts (FSA)
• CareCredit healthcare financing
• Cash, check, and major credit cards

8. Telehealth Services

Neuron Connect may offer remote telehealth consultations for select services. All telehealth sessions are subject to these same Terms of Service and to the same privacy protections and clinical standards as in-person visits.

The patient is responsible for ensuring a secure, private internet connection for telehealth sessions. You acknowledge that telehealth has inherent limitations including potential interruptions in connectivity, and that certain services (such as qEEG brain mapping) require in-person attendance. Telehealth availability is subject to applicable Arizona and federal regulations governing remote healthcare delivery.

9. Intellectual Property

The Neuron Connect website and its entire contents (including but not limited to all text, graphics, images, blog content, video, audio, logos, and the design, selection, and arrangement thereof) are owned by Neuron Connect or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without the prior written consent of Neuron Connect.

10. Prohibited Uses

You may use our website and Services only for lawful purposes. You expressly agree not to:

• Misrepresent your identity or impersonate any person or entity.
• Attempt to gain unauthorized access to any portion of our website, server, network, or database.
• Use any automated means (including bots, spiders, or scrapers) to access, harvest data from, or monitor the website.
• Interfere with or disrupt the operation of the website or the servers and networks connected to it.
• Upload, post, or transmit any viruses, malware, or other harmful code.
• Use the website in any manner that could violate applicable federal, state, or local laws or regulations.
• Engage in any conduct that restricts or inhibits any other person from using or enjoying the website.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Neuron Connect, its affiliates, directors, officers, employees, agents, or licensors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including without limitation, loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure) arising out of or related to your use of, or inability to use, the website or Services, even if Neuron Connect has been advised of the possibility of such damages. In no event shall Neuron Connect's total aggregate liability to you for all claims related to the Services exceed the total amount paid by you to Neuron Connect for the specific services giving rise to the claim in the six (6) months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Neuron Connect and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and attorneys' fees arising out of or related to your violation of these Terms or your use of the website or Services, including but not limited to the submission of false or misleading information, unauthorized use of the site, or any conduct that violates any third-party rights.

13. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter through good faith negotiation by contacting Neuron Connect directly at BrainTrain@neuron-connect.com.

If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in Maricopa County, Arizona, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Neuron Connect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. To the extent that any dispute proceeds in court rather than arbitration, you consent to personal jurisdiction in, and agree that the exclusive venue for any legal action or proceeding shall be, the state and federal courts located in Maricopa County, Arizona.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions, which shall continue in full force and effect.

16. Changes to Terms

Neuron Connect reserves the right to modify or update these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page and post a notice on our website for material changes. Your continued use of the website or Services after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must discontinue use of the Services.
